Virginia's Heat Illness Law, Chapter 731, and What It Will Ask of Contractors by 2028

Virginia moved heat illness prevention out of guidance and into statute in 2026. HB 1092 passed the General Assembly and became Chapter 731 of the 2026 Acts of Assembly, approved on April 13, 2026. It created a new section of the Code of Virginia, 40.1-44.2, titled Standards for heat illness prevention. If you run job sites in the Commonwealth, this is the document to read rather than a summary of it.
The statute does not itself impose a set of workplace requirements. It directs the Safety and Health Codes Board, working with the Department of Labor and Industry, to develop and adopt regulations, and it fixes a deadline of May 1, 2028. This is the single most commonly misreported fact about the law. Earlier introduced versions of HB 1092 carried a May 1, 2027 date, and secondary summaries continue to repeat it. The enacted chapter text says 2028.
What the statute does do is describe the substance the eventual regulations must contain. Employers will need to provide water, access to shade or climate-controlled environments when practicable, rest periods, acclimatization to working in heat, and effective training on heat illness prevention. They will need heat and high-heat procedures that kick in when temperatures reach thresholds the Board sets. And they will need effective emergency response procedures.
Two exemptions are written in. Emergency services work is excluded, and that is defined broadly enough to cover law enforcement, EMS, firefighting, rescue and evacuation, emergency highway work and emergency utility restoration. Heat exposure lasting no longer than 15 consecutive minutes is also excluded. If your crews are on continuous outdoor work through a Virginia summer, neither exemption is going to apply to you.
The Board has been given a specific reading list. It must consider the Virginia Department of Labor and Industry's own 2021 Draft Heat Illness Prevention Standard along with federal OSHA, NIOSH, ACGIH and ANSI material, and it must convene an advisory panel at least half composed of employee advocates. That list tells you roughly what shape the Virginia regulation will take: temperature triggers, rest, shade or cooling, and training.
For anyone sizing up a purchase or a rental decision, the phrase that matters is access to shade or climate-controlled environments when practicable. That wording is in the Code of Virginia, chosen by the legislature. A climate-controlled crew room on a job site is a direct answer to it. Contractors who bring one in now are aligned with where the regulation is heading and are also getting a working benefit from it in the meantime, which is a better position than scrambling in 2028.
Worth knowing alongside all this: Virginia operates its own OSHA state plan, VOSH, which covers most private sector workers plus all state and local government workers. And federal OSHA runs a National Emphasis Program on outdoor and indoor heat hazards under directive CPL 03-00-024, dated April 10, 2026. A National Emphasis Program means programmed inspections targeting heat, not just responses to complaints. The enforcement environment is already active while the Virginia regulation is being written.
The practical move for a site lead is simple. Read the enacted chapter text yourself, note the 2028 date, build the controls the statute names into your heat plan now, and treat a cooled crew break space as part of the plan rather than as an amenity. The other benefit shows up on the productivity side long before any regulation does.

Why a Normal Richmond July Afternoon Already Feels Like 92 Degrees
The Western states sell heat on the thermometer, and they can, because Phoenix and Las Vegas hit numbers Virginia never sees. Virginia's heat argument is different and in some ways harder to dismiss, because it is about the felt temperature rather than the measured one, and the felt temperature is exactly what the pending federal rule triggers on.
NOAA's National Centers for Environmental Information publishes 30 year climate normals, currently covering 1991 through 2020. The hourly normals product gives you the average air temperature, dew point and heat index for a specific hour of a specific date. Pull July 15 at 3 p.m. local standard time, the hour of peak heat index, for five Virginia stations and a clear picture comes out.
Richmond International reads 88.1 degrees of air temperature and a 92.0 degree heat index, with a 67.1 degree dew point. Norfolk International reads 86.2 degrees of air and a 90.3 degree heat index, driven by a 68.4 degree dew point, which is the highest of the five. Washington Dulles, out in Loudoun County, reads 86.2 and 89.1. Lynchburg reads 85.3 and 87.6. Roanoke reads 85.1 and 86.8.
The number to hold onto is that Richmond and Norfolk both sit at or above 90 degrees of felt heat on an average July afternoon. OSHA's pending federal proposal sets its high heat trigger at a heat index of 90 degrees and its initial trigger at 80. Two of Virginia's three largest metro areas cross the high trigger on a normal day, and all five stations clear the initial trigger by a wide margin for weeks at a stretch.
The annual counts fill in the rest. Richmond averages 42 days a year at or above 90 degrees, with 15.9 of them in July alone and a July average high of 89.7. Norfolk averages 27 days at or above 90, and Roanoke 25. Lynchburg comes in lowest of the five at 21.7. The heat season across the state runs June through August, opening in May and closing in September in Hampton Roads and the Richmond region.
Humidity is why the felt number outruns the measured one, and it is also why shade alone does not solve the problem here the way it partly does in a dry climate. A canopy blocks radiant load but it does nothing to the dew point. The pending federal proposal recognises this directly. Its language on break areas says they must have artificial or natural shade or be an air-conditioned space, and it lists trailers among the examples. It also says its own baseline assumption for an employer with no existing break area is a 12 by 12 foot tent.
Then there is the other half of the calendar, which almost nobody accounts for when they budget. Washington Dulles records 102.5 nights a year at or below freezing. Lynchburg records 99. Roanoke records 78, Richmond 73.5, and Norfolk 42.4. That means a Loudoun County job site has roughly three and a half months of freezing nights and one month of 90 degree days. Both problems are the same problem: crews need somewhere with mechanical air close to the work.
For a site lead the takeaway is a planning one. If you are budgeting cooled crew space in Virginia only for June through August you are buying about a third of the value. The units that heat as well as cool tend to stay on Virginia sites year round, and the January case is usually the one that convinces people to keep them.

Hampton Roads Job Sites: Tunnels, Shipyards and the Humidity Problem Nobody Budgets For

Hampton Roads is the second largest metropolitan area in Virginia at just under 1.8 million people across seven cities, and almost all of its heavy construction happens outdoors on steel, concrete or water. It is also the part of the state where the gap between measured temperature and felt temperature is widest, which makes it the clearest case in Virginia for cooled crew space.
Start with the work. The Hampton Roads Bridge-Tunnel Expansion is the largest highway construction project in Virginia's history, running nearly ten miles of Interstate 64 with twin two-lane bored tunnels under the harbor between Hampton and Norfolk. As of August 2026 both bored tunnels are complete, the South Trestle opened in November 2025, the North Trestle is carrying traffic, and the tunnel boring machine is being taken apart. VDOT reports that 92 percent of the project is paid for by the Hampton Roads Transportation Accountability Commission with regional controlled funds.
Across the water, Newport News Shipbuilding was awarded approximately 76.6 billion dollars in contract modifications on July 29, 2026 for five additional Columbia-class and nine additional Virginia-class submarines, together with funding for shipyard infrastructure. Newport News is the delivery yard for six of the Virginia-class boats and builds six module sections for each Columbia-class boat. Shipyard infrastructure funding means construction inside an operating yard, which is a category of work with almost no spare indoor space.
Now the climate. Norfolk International's 30 year normals put the air temperature at 86.2 degrees on a mid-July afternoon, which does not sound alarming. The heat index at the same hour is 90.3, because the dew point sits at 68.4 degrees, the highest of the five Virginia stations. That felt temperature sits at the high heat trigger in OSHA's pending federal proposal, on an average day rather than during a heat wave.
Those numbers understate what a crew actually experiences on this kind of work. A steel deck, a tunnel approach or a paved laydown yard sits meaningfully hotter than the reported air temperature, and a shade canopy does nothing at all about the dew point. Humidity is why the East Coast case has to be made on heat index rather than thermometer readings.
The winter picture is the reverse of the rest of the state. Norfolk averages only 42.4 nights a year at or below freezing, the mildest of the five Virginia stations and less than half the count at Washington Dulles. In Hampton Roads, a rented crew room earns most of its value on the cooling side, where in Loudoun County or Lynchburg it splits its year fairly evenly between heating and cooling.
Practically, the constraints on these sites are access and space rather than distance. Yards have gates, badges, tight laydown and active operations running alongside the construction. A unit that arrives delivered, set up and powered, sized to fit a laydown slot and able to relocate on dual axles as the work face moves, fits that reality better than anything that has to be assembled on site. Plan the placement into your site logistics early, because on a working waterfront the space gets committed long before the summer does.

Working the I-81 Corridor: Break Space That Moves With a Sixty-Mile Job
There is more construction on Interstate 81 right now than at any point since the road was built. VDOT reports it is less than seven years into the I-81 Corridor Improvement Program and has already completed 40 of 65 planned construction projects, with 17 more under construction. The agency itself describes this as the most activity on the corridor since it was originally built roughly sixty years ago.
The program is worth about four billion dollars and is funded through regional fuels taxes and Virginia's Interstate Operations and Enhancement Program. Work is live simultaneously in Frederick, Warren, Shenandoah, Rockingham, Augusta and Rockbridge counties, which is most of the length of the Shenandoah Valley. Two segments show the pattern clearly. A six-mile widening through Harrisonburg and Rockingham County began construction in April 2026. A four-mile widening near Staunton between Exit 221 and Exit 225 has passed 60 percent complete.
Interstate widening is a fundamentally different logistics problem from a building. There is no footprint. The crew is a moving front that advances down the corridor across a season, and the distance between where they started in April and where they are in August can be measured in exits rather than feet. Anything fixed becomes the wrong distance from the work within weeks.
The pending federal heat rule addresses this directly and in plain language. For mobile work sites, it says, such as in road construction or utility work, the employer would be expected to relocate the break area as needed to ensure it is readily accessible to employees, or ensure each work site has its own break area for use. The proposal also states that a break area requiring more than a few minutes to reach is not reasonably accessible and that travel time to it must be paid.
That is why relocatability is a specification and not a convenience on this kind of work. A unit on dual axles with electric brakes, connected through a shore cord to temporary power, can be moved along a corridor in a normal working day. Crews on these projects commonly move break space several times across a season rather than committing to one location or renting several units to cover a spread-out job.
The Valley has a second workforce that runs on a completely different calendar. Rockingham County leads Virginia in chickens, turkeys and dairy production, and its own Board of Supervisors chair describes it as the number one agricultural producing county in the Commonwealth. In April 2026 the Virginia Poultry Growers Cooperative announced a 113.9 million dollar expansion creating 146 jobs, including a feed mill of nearly two million cubic feet with the largest grain storage capacity on the East Coast, a rail spur at its Linville facility and water treatment upgrades at Hinton.
That means two overlapping demands in the same counties. Processing and harvest crews work long shifts in facilities where interior space is already committed, and on top of that there is construction crew demand from the plant expansions themselves. Both peak in warm weather and both sit in a county of about 89,000 people where there is not much nearby to absorb the overflow.
The Valley's climate rounds out the case. Roanoke, at the southern end of the corridor, averages about 25 days a year at or above 90 degrees but 78 nights at or below freezing, and Lynchburg records 99 freeze nights. Crews on this corridor face heat in July and hard cold in January, on the same open ground, which is why break space here has to do both jobs rather than one.
