What the Proposed Federal Heat Rule Would Actually Ask of Your Break Area

On August 30, 2024, OSHA published a proposed standard called Heat Injury and Illness Prevention in Outdoor and Indoor Work Settings, at 89 FR 70698. It is a proposal, not a final rule, and the honest way to describe its status is that the comment periods have closed, the hearings are finished, and the Department of Labor has said it intends to finalize it. Nothing in this article is a compliance requirement today. It is a very good map of where the requirements are heading, and it was written with enough specificity that a contractor can plan against it.
The passage that matters most to anyone renting a break space is short. Break areas, the proposal says, must be readily accessible to the work area and able to accommodate the number of employees on break, and they must have artificial or natural shade or be an air conditioned space. The examples the agency gives for that air conditioned space are trailers, vehicles, and structures. It is unusual for a federal proposal to name a product category that plainly, and it is worth reading twice.
The comparison the proposal sets up is just as useful. In costing the rule, OSHA assumed that employers without an existing break area would use artificial shade in the form of a 12 by 12 foot tent that all employees on break can reasonably access. That tent is the baseline the agency priced. Any contractor deciding between a tent and a conditioned trailer is making exactly the comparison the federal government already framed.
Two triggers run the rest of the proposal. The initial heat trigger is a heat index of 80 degrees, or a wet bulb globe temperature equal to the NIOSH Recommended Alert Limit. The high heat trigger is a heat index of 90 degrees, or a WBGT at the NIOSH Recommended Exposure Limit. Heat index, not air temperature, is the measure, which is why Gulf Coast and Southeast sites cross these lines far more often than a thermometer reading suggests, and why humid regions should not assume the rule is aimed at the desert.
Accessibility gets more attention in the proposal than most summaries mention. A break area requiring more than a few minutes to reach would not be considered reasonably accessible, and travel time to the break area would be paid time. On a large plant or campus, that turns the location of the break space into a payroll question, not just a comfort question. A break area that is not large enough for employees to move in and out freely, or to reach water and air conditioning or shade, would also fall short.
For mobile work the proposal says something that reads like a product description. For mobile work sites, such as in road construction or utility work, the employer would be expected to relocate the break area as needed to ensure it is readily accessible to employees, or to ensure each work site has its own break area. A corridor job that moves three miles down the road every few weeks is squarely inside that sentence.
What should a contractor do with all of this while the rule is still pending? Three things are safe and useful. Write down where the break area is on each site and how long it takes to walk there. Make sure that space can be cooled, not just shaded, and heated when the season turns. And build the plan so it travels, because the work moves and the proposal expects the break area to move with it. Every State Heat Rule Names Air Conditioning. Here Is What That Means for a Multi State Contractor
A contractor working one state can learn one rule. A contractor working six is managing six answers to the same question, written by six different drafting teams in six different decades. The useful discovery, if you read the actual regulation text rather than summaries of it, is that they converge. Every state that wrote a heat standard wrote air conditioning into it as an accepted answer, usually in the regulation's own words.
California is the strictest and the most specific. The outdoor standard, 8 CCR 3395, sets the shade trigger at 80 degrees and high heat procedures at 95, and its definition of shade includes a line worth quoting to anyone still thinking about a tent: a car sitting in the sun does not provide acceptable shade to a person inside it, unless the car is running with air conditioning. The indoor standard, 3396, goes further and sets a number. Cool down areas must be maintained at less than 82 degrees Fahrenheit at all times while employees are present, unless the employer demonstrates it is infeasible. A shade structure cannot hold a number like that on an August afternoon. A conditioned space can.
Washington's rule, WAC 296-62-095 and the sections that follow, measures dry bulb temperature and starts at 80 degrees, dropping to 52 degrees for workers in vapor barrier protective clothing. It lists misting stations, cooling vests, and air conditioned areas as alternatives to shade. The clause that matters commercially opens the high heat section: those procedures apply unless engineering or administrative controls, air conditioning named among them, lower employee exposure below 90 degrees.
Oregon says it even more plainly, in the only one of the three rules that covers indoor and outdoor work together on heat index. OAR 437-002-0156 exempts buildings and structures with mechanical ventilation that keeps the heat index below 80 degrees, and its written plan asks how employees will get space to rest in a shaded area or a cool climate controlled area.
The reason a superintendent should care is on Oregon's rest schedule. Under the simplified table, a 90 degree heat index buys 10 minutes of paid rest every two hours. At 95 degrees it is 20 minutes every hour. At 100 it is 30 minutes. At 105 degrees it is 40 paid minutes out of every hour worked. Washington's table runs 10 minutes every two hours at 90 degrees and 15 minutes every hour at 100. Every one of those minutes is paid, and in both states cooling that holds exposure below the trigger takes the requirement off the table. That is a labor hour calculation a contractor can run against his own payroll, which is a more honest argument than any claim we could make.
Beyond those three, the map is moving rather than settled. Nevada has enforced its own heat illness prevention regulation since April 2025, built around written programs and hazard analysis rather than a temperature trigger. Colorado signed a statewide extreme temperature worker protection framework in June 2026, with a reporting platform due in January 2027 and a model prevention plan due July 1, 2028. Virginia's safety and health codes board is under a statutory deadline of May 1, 2028. Where the standard is still being written, the sensible move is to build to the federal proposal, since that is the direction all of these point.
For a company running crews in several states, the practical takeaway is to build to the strictest rule you touch and deploy it everywhere. A conditioned break space satisfies California's cool down number, lifts the paid rest cadence in Oregon and Washington, and is exactly the example the federal proposal names. It also covers the second season, since California, Washington, and Oregon all treat an enclosed, mechanically filtered space as a named control under their wildfire smoke rules. Winter Work: Building a Warm Up Plan Your Crew Will Actually Use

Ask a contractor in Denver, Yakima, or Cleveland what a break room trailer is for and you will get a different answer than you would on the Gulf Coast. Denver averages about 156 days a year with a freeze. Yakima averages 148, Salt Lake City about 112, Cleveland about 104, and Columbus about 98. Bend and Burns, in Oregon, run near 181 and 200. In those places the cooling season is the shorter half of the year, and the warm up plan is the one that has to work.
Federal guidance on cold is less prescriptive than the heat material, and that is worth understanding rather than glossing over. OSHA's winter weather guidance tells employers to schedule frequent short breaks in warm dry areas to allow the body to warm up, to schedule work during the warmest part of the day, to use the buddy system, to provide warm sweet beverages without alcohol, and to monitor workers' physical condition. Enforcement runs through the General Duty Clause, the same clause that governs heat while the heat standard is still proposed.
The practical failure mode on most winter sites is not that nobody thought about it. It is that the warm up space is a pickup truck with the engine idling. Trucks fill up fast, they burn fuel all day, they put an exhaust hazard next to people, and a crew of 20 cannot fit into three cabs. So people cut breaks short, come back cold, and the afternoon gets slower and sloppier at exactly the point of the day when hands are already tired.
A conditioned trailer solves that in a boring, reliable way. Ours carries a 24,000 BTU mini split that heats as well as it cools, plus two 1,500 watt backup heaters for the mornings that get away from you. It runs on a 240V 50 amp shore cord or a site generator, so it works before the building has permanent power. Twenty four feet of enclosed space with bench seating, a microwave, and a refrigerator gives a crew somewhere to actually thaw out instead of rotating through truck cabs.
A good warm up schedule is written before the first cold snap, not during it. Base the break cadence on temperature and wind speed together, not temperature alone, because wind chill is what drives frostbite risk on exposed skin. Put the warm up space close enough to the work that a 10 minute break is 10 minutes of warming rather than 6 minutes of walking. And write down who is watching for the early signs, since shivering, clumsiness, and confusion are exactly the symptoms the affected worker is least able to notice in himself.
There is a retention angle here too, and it is not a soft one. With more than four out of five construction firms reporting difficulty filling hourly craft positions, the crew you already have is the scarce asset on the job. A heated room at 6 a.m. in February is one of the few site conditions a contractor completely controls, and every worker on the site notices whether it exists.
The simplest version of the plan is one unit that covers both directions. The trailer that keeps a crew cool in July is the one that keeps them working in January, on the same rental, on the same site. On a Data Center Campus, the Building's Own Break Room Is Always Last
Data center construction has become the most reliable source of crew break space demand in the country, and the reason is a scheduling quirk rather than a heat statistic. Contractors in the AGC's 2026 outlook survey named data centers their strongest market by a wide margin, with 65 percent expecting the segment to grow against 8 percent expecting it to shrink. National data center construction spending ran at roughly 50.7 billion dollars on an annualized basis in April 2026, up about 27 percent in a year. The work is there, and it is concentrated.
Look at where. Metro Atlanta holds roughly 2,076 megawatts under construction, close to 35 percent of the North American pipeline, at about 2 percent vacancy across Fulton, Douglas, Fayette, Walton, and Cobb counties. Loudoun County, Virginia remains the largest data center market on earth. West Texas has the Abilene campus running toward roughly 9,000 craft workers on site daily. Individually, each is a huge job. Together they are a national labor pattern, with crews and general contractors moving between them.
The headcount shape is what makes break space a real problem instead of an amenity. Virginia state analysts count roughly 1,500 workers on a single data center jobsite at peak. A hyperscale building takes 12 to 18 months, and greenfield to service commonly runs 30 to 66 months. Once a facility opens it runs on a fraction of that crew, roughly one permanent operations employee for every five construction workers who built it. The site's population is enormous, temporary, and lopsided toward the middle of the schedule.
Now the scheduling quirk. Server halls have to be held inside a narrow temperature and humidity band before any hardware is delivered, and the permanent air handling cannot run at partial construction load to do it. Commissioning that system is one of the last major milestones. Everything that depends on it, including the building's own break rooms, lands at the end of the interior finish sequence, which is precisely when electrical and mechanical headcount is at its highest. The permanent break room shows up months after the crew that needed it.
Phased occupancy stretches the gap. Several buildings can be live and operating, secured and off limits to construction crews, while several more are still going up behind the same fence. A campus can look finished from the road and still have 1,200 people on it with nowhere to sit down.
Contractors solved the logistics side of this years ago, and the vocabulary proves it. Site shuttle plans on large campuses route crews to the main gate, the trailer compound, and the laydown yard. The trailer compound is already a named element on the plan. Adding a conditioned break unit to a compound that already exists is a small change to a system the site already runs, which is why it goes in without a fight.
The unit itself does more than hold lunch on these jobs. Twenty four linear feet of magnetic whiteboard wall and a 32 inch TV make it the natural place for the morning stand up, the job hazard analysis, and new hire orientation, all of which happen daily on a site with rotating trades. Two built in desks and Starlink Wi-Fi mean an inspector or a commissioning engineer can sit down and work without driving back to the field office. On a campus with 1,500 people, one room that does three jobs is worth more than three rooms that do one.
